Labour Hire, Subcontractor Injury Exclusion

When you are new to the world of insurance, you may be surprised that some insurer put what they call a “Worker to Worker Injury Excess” of upto $50,000 but most commonly between $10,000 to $25,000 if there is a claim on you for injury to either a labour hire worker or another contractor on site.

Even worse like in the example below where the insurer simply wouldn’t pay such a claim. This is a very critical condition that must be checked on your insurance.

Restricted Locations

Usually one of the most common exclusions on an insurance policy where the insurer lists a set of locations that are excluded for cover.

Earthmoving Insurance – Claim Example

One of our client’s was doing some civil works and had dug up a trench along a road. That trench had been covered by a driving plate that allowed access to a medical centre from the road.

Whilst the client had taken care that the driving plate was set up properly somehow a 200 series Landcrusier has driven on it and the driving plate has failed resulting in the front wheels going in the trench and minor damage to the front bumper bar and a little bit to the under body of the landcruiser.

The owner of the landcruiser has demanded that our insured pay the costs to fix his vehicle. The claim was accepted by the insurer. See photos below:
